Welcome to Morning Attire. These Terms of Service ("Terms") govern your use of our website morningattire.com and any purchases you make from us. The terms "we," "us," and "our" refer to Morning Attire LLC, a limited liability company organized under the laws of the State of Wisconsin, located at 200 E. Verona Avenue, Suite 1001, Verona, WI 53593. By accessing or using our website, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, please do not use our website.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to make a purchase. If you are under 18, you may browse our website but must have a parent or legal guardian complete any purchase on your behalf.

Products and Pricing

All products are subject to availability. All of our apparel products are made-to-order using print-on-demand production — each item is printed and produced specifically for your order after purchase. Prices are listed in US dollars (USD) and do not include applicable sales tax or shipping charges, which are calculated and displayed during checkout. We reserve the right to modify pricing at any time; however, price changes will not affect orders that have already been placed and confirmed. We make every effort to display product colors and images accurately; however, actual colors may vary slightly due to monitor settings and display calibration. Minor variations inherent to the print-on-demand manufacturing process do not constitute defects.

Orders and Payment

By placing an order, you are making an offer to purchase. Your order is confirmed when you receive an email confirmation from us. We reserve the right to refuse or cancel any order due to product unavailability, pricing errors, or suspected fraud. If we cancel your order, you will receive a full refund. Because our products are made to order, cancellations may be requested within 2 hours of order placement, provided production has not yet begun. Payment is processed securely through Shopify Payments at the time of order placement. We accept major credit cards, debit cards, Apple Pay, Google Pay, and Shop Pay.

Shipping and Delivery

Shipping timelines, costs, and policies are detailed in our Shipping Policy. Estimated delivery dates are not guaranteed and may vary due to carrier volume, weather, or other factors outside our control. Once we transfer products to the shipping carrier, title and risk of loss passes to you. Please ensure your shipping address is accurate — we are not responsible for packages delivered to an incorrect address you provided.

Returns and Refunds

Our return and refund policies are detailed in our Refund & Return Policy. Because our products are made-to-order, we cannot accept returns for change of mind. We will replace or refund items that arrive defective, damaged, misprinted, or incorrect, when reported within 7 days of delivery.

Intellectual Property

All content on this website, including text, photographs, images, graphics, logos, designs, and artwork, is the property of Morning Attire LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission. You may share links to our website and products for non-commercial purposes. All rights not expressly granted herein are reserved.

User Conduct

You agree to use our website only for lawful purposes. You may not: attempt to gain unauthorized access to any part of our website or systems, use automated tools to scrape or extract content, submit false or misleading information, upload viruses or malicious code, or engage in any activity that could damage or impair our website. We reserve the right to restrict access to any user who violates these Terms.

Disclaimer of Warranties

Our website and products are provided "as is" and "as available" without warranties of any kind, either express or implied, except as required by applicable law, including all implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that our website will be uninterrupted, timely, secure, or error-free. Nothing in this section excludes or limits any warranty that cannot be excluded or limited under applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Morning Attire LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of our website or products, regardless of the theory of liability and even if we have been advised of the possibility of such damages. Our aggregate liability to you for all claims arising out of or related to the Services or any product shall not exceed the total amount you actually paid to Morning Attire LLC for the specific product(s) giving rise to the claim. Nothing in this section excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Morning Attire LLC, its owners, members, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any applicable law or the rights of any third party, or your misuse of the Services. This obligation survives termination of these Terms.

Force Majeure

Morning Attire LLC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, fire, flood, or severe weather; war, terrorism, civil unrest, or government action; labor disputes or work stoppages; disruptions to utilities, telecommunications, or internet service; supply chain disruptions or manufacturing delays at our production partner facilities; or shipping carrier delays, customs holds, or postal service interruptions. In such events, our obligations will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume performance as soon as practicable.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Before initiating any formal proceeding, you agree to contact us at support@morningattire.com to attempt to resolve the dispute informally. If a dispute is not resolved within thirty (30) days, it may be brought exclusively in the state or federal courts located in Dane County, Wisconsin. You agree to submit to the personal jurisdiction of these courts. Either party may bring an individual action in small claims court for claims within the court's jurisdictional limits. To the extent permitted by applicable law, you and Morning Attire LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. Nothing in this section excludes or limits any non-waivable rights or remedies you may have under applicable consumer protection law.

Termination

We may suspend or restrict access to the Services if we reasonably believe you have violated these Terms or misused the Services. You may close your account at any time by contacting us at support@morningattire.com. Upon termination, your right to use the Services will immediately cease. You will remain liable for all amounts due up to and including the date of termination, including any outstanding orders already in production. The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Morning Attire LLC regarding your use of the Services, superseding any prior agreements or communications.

Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website after changes are posted constitutes your acceptance of the revised Terms.
